СУДОВА РЕФОРМА І РАЦІОНАЛІЗАЦІЯ СУДОВОЇ СИСТЕМИ УКРАЇНИ

Анотація

Статтю присвячено аналізу структури судової системи України на нинішньому етапі її реформування. Висловлено позиції автора щодо завдань формування структури судів загальної юрисдикції, переліку елементів цієї структури. Досліджено вплив принципів територіальності, спеціалізації та інстанційності на формування структури судової сис­теми України. Детально проаналізовано стан визначення рівнів судової системи України і решти європейських країн, висловлено пропозиції щодо удосконалення відповідних норм українського законодавства. Висловлено думку щодо перспектив розвитку спеціа­лізації судів в Україні. Проаналізовано характер проблем, які виникають у цій сфері між Україною та Венеціанською комісією, і окреслено шляхи їх вирішення.

This article analyzes the structure of the judicial system of Ukraine at the present stage of its reform. Expressed the author's position relative to the tasks of forming the structure of courts of general jurisdiction, the list of elements of this structure. The influence of the principles of territoriality and specialization instantsionnosti on the structure of the judicial system of Ukraine. Analyzed in detail the state determination of the levels of the judicial system of Ukraine and other European countries, suggestions for improvement of the relevant norms of Ukrainian legislation. Expressed about the prospects of specialization of courts in Ukraine. Analyzed the nature of problems in this sphere between Ukraine and the Venice Commission and outlined ways to resolve them.
